(THE “GAME”) OFFICIAL RULES

NO PURCHASE NECESSARY TO PARTICIPATE OR WIN. MANY WILL PLAY,
FEW WILL WIN. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING A PRIZE.

  1. How to Play: There are two (2) ways to play during the Game Period (as defined below), 1. game pieces can be found under the over wraps of specially marked DANNON® Danimals Drinkables 4-pk, 8-pk, 15-pk, 24-pk (3.1 oz.), and Danimals 8-pk and 12-pk (4 oz. cups), while supplies last. To play, open the carton overwrap carefully on participating Danimals products and look underneath to see if you are a winner. If game piece reveals you are a winner, you win the prize indicated, subject to verification and validation of the game piece, your eligibility and compliance with these Official Rules. OR, 2. To obtain a free game piece (while supplies last) and/or a copy of these Official Rules, mail a self-addressed, stamped #10 envelope (SASE) to: The Naked Brothers Band Rock Your Block Party Instant Win Free Game Piece/Official Rules Request, P.O. Box 1938. Danbury, CT 06813-1938. Limit one (1) request per stamped outer envelope per day. Requests must be postmarked by 10/31/08 and received by 11/7/08. (VT residents may omit return postage.) Please specify game piece or rules request. You can also go to www.danimals.com or www.nick.com/rockyourblock for these Official Rules. To redeem a prize, hand print your name, complete address (no P.O. Boxes), phone number (including area code), date of birth, and name and signature of parent or legal guardian (“Parent”) if you are a minor, on a 3" x 5" piece of paper and mail, with your entire original potentially winning game piece via certified mail, return receipt requested, to: The Naked Brothers Band Rock Your Block Party Prize Claim, P.O. Box 1939, Danbury, CT 06813-1939. Prize claims must be received by 11/28/08 or they are void. Make and retain photocopies of the potentially winning game piece before mailing as proof of mailing does not constitute proof of receipt. Mechanical reproductions are void. 
  2. Game Period: Game begins on or about 7/1/08 and is scheduled to end 10/31/08 or upon distribution of all game pieces, whichever is sooner (the “Game Period”).

    Prizes/Approximate Retail Value/Odds of Winning: One (1) Grand Prize: Grand Prize winner will win a Block Party for winner and up to fifty (50) attendees. at which MTV Network (“MTVN”) and Sponsor will take over Grand Prize winner’s street (or an alternate venue as determined by Partner) for the day.  Various members of the Naked Brothers Band (“NBB”), including the characters Nat and Alex (subject to the terms below), may appear at the Block Party for a meet and greet photo opportunity and will act as the master of ceremonies at the Block Party (hereafter, the “Block Party”). The timing of fulfillment is subject to the band members’ professional availability. Block Party shall take place no later than July 29, 2009.  Winner will also be awarded $10,000 in spending money (to be awarded as a check) to be made out in winner’s name and a guitar autographed by members of the NBB.  If Grand Prize winner is considered a minor in his/her state of residence, the entire Grand Prize will be awarded in the name of his/her parent or legal guardian.  Approximate Retail Value (“ARV”) of all of the elements of the Block Party: $15,000. Winner will be allowed to invite up to 50 attendees to the Block Party. Sponsor or its representative will coordinate with winner (or, if a minor, his/her Parents) with respect to all details regarding Block Party. Sponsor reserves the right to adjust the maximum number of attendees of the Block Party, regardless of where it is held, at Sponsor’s sole discretion. Sponsor and MTVN reserve the right to photograph, record and videotape the Block Party and interview attendees, and use said materials for advertising and promotion purposes in any and all media now known or hereafter created throughout the world in perpetuity.  Attendees (or, if eligible minors, their Parents) may be required to execute and return a liability/publicity release prior to attendance at Block Party, which shall include, unless prohibited by law, a grant to Sponsor, MTVN, and their respective designees of the right to use of their name, likeness and performance for publicity and advertising purposes in any and all media now or hereafter known throughout the world. Winner and attendees are responsible for transportation to/from Block Party, at their sole cost and expense. MTVN and Sponsor will make reasonable efforts to arrange for all members of the NBB, including the characters Nat & Alex Wolff, to appear at the Block Party, subject to availability.  Winner and Block Party attendees must comply with the Block Party and activity rules and regulations. Failure to do so may result in forfeiture of such portion of Grand Prize. All Block Party details, including the length and appearance of NBB are to be designated by Sponsor.  If, for any reason, outside of the control of the Sponsor or MTVN, Sponsor is unable to provide a Block Party or a live appearance by Nat and/or Alex Wolff, or other NBB band members, no compensation or substitution will be provided; however, remainder of prize package will be awarded and Sponsor will have no further obligation to winner. Odds of winning the Grand Prize: 1: 30,000,000; Two thousand five hundred (2,500) First Prizes: Each first prize winner will receive a Naked Brothers Band CD (ARV: $12.00 each), Odds of winning a First Prize 1: 12,000. Total ARV of all prizes: $45,000. Prizes are awarded “as is” with no warranty or guarantee, either expressed or implied by Sponsor. Potential winners will be notified by U.S. Mail on or before 12/15/08. In the event that there are unclaimed prizes in the Game, only those unclaimed prizes will be awarded in the Second Chance Drawing provided a sufficient number of eligible entries are received.

    SECOND CHANCE DRAWING: To enter the Second Chance Drawing, hand print your complete name, complete address, date of birth, evening phone number (with area code) and Parent’s name and signature on a 3" x 5" card and mail it with proper postage affixed to: The Naked Brothers Band Rock Your Block Party Second Chance Drawing, P.O. Box 1940, Danbury, CT 06813-1940. Enter as often as you wish, but each Second Chance entry must be mailed in a separate, first-class stamped envelope and received by 12/22/08. No mechanical reproductions permitted. Second Chance Drawing will, if required, be held on or about 12/31/08 from among all eligible Second Chance entries received by an independent agency, whose decisions are final and binding, and such potential winner(s) will be notified via mail and/or phone and required to comply with all requirements imposed on winners set forth in these Official Rules. Odds of winning a prize in the Second Chance Drawing, if any, will depend on the number of unclaimed prizes and number eligible Second Chance entries received. All Second Chance entries become the property of the Sponsor and will not be returned. 
  3. Prize Restrictions: No substitution, cash redemption or transfer of prizes permitted by winners. Sponsor reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, at its sole discretion. All federal, state and local taxes, and all costs and expenses related to the acceptance and use of the prizes not specified in these Official Rules as being awarded are the sole responsibility of the winners. All prize details are at Sponsor’s sole discretion. Limit one (1) prize per person and per household. Potential Grand Prize winner (and, if a minor, his/her Parent) will be required to execute and return an affidavit of eligibility, a liability release and where legal, a publicity release and a W-9 form, within fourteen (14) days of date of issuance specified in the notice. If Grand Prize winner is an eligible minor, Sponsor reserves the right to award the prize to his/her Parents who must join in any grant of rights and releases granted by the winner and indemnify Sponsor and MTVN with respect to any acts or omissions of minor, including failure to report or pay taxes on the prize and otherwise fulfill all requirements imposed on the Grand Prize winner as set forth herein. Failure to return the documents within the specified time period, the return of a prize or prize notification as undeliverable, noncompliance with these Official Rules or Sponsor’s inability to contact potential winner within a reasonable time period may result in prize forfeiture, and such prize will be awarded in the Second Chance Drawing (as described above). First Prizes will be mailed approximately 6-8 weeks following verification of game piece, eligibility and compliance with the terms of these Official Rules.
  4. Other Conditions: Released Parties (as defined below in Section 7) are not responsible for lost, late, stolen, incomplete, illegible, inaccurate, mutilated, postage due, undelivered, delayed or misdirected mail, claims, game pieces, requests or Second Chance entries; or for any error or problem of any kind relating to or in connection with the Game including, without limitation, errors or problems which may occur in connection with the administration of the Game, the processing of requests, claims, game pieces or Second Chance entries, the announcement of the prizes, and any other activities in connection therewith, or in any Game-related materials. You are not a winner until your game piece has been verified and it is determined that you have complied with all terms of these Official Rules. Any game piece submitted that has been forged, altered, torn, defaced, tampered with, duplicated or are irregular in any way may be disqualified. Game pieces are void if they contain any printing, mechanical, seeding, typographical, human or other errors, or are obtained other than through authorized channels. Only the number of prizes stated herein will be awarded. If printing, mechanical, seeding, typographical, human or other errors result in more valid prize claims for any level than the number stated herein available, Sponsor reserves the right to award the stated number of prizes for such level in a random drawing from among all eligible, non-suspect and valid claims received for that prize level. All materials submitted become the property of Sponsor and will not be returned.
  5. Eligibility: The Game is open to legal residents of the 50 United States or the District of Columbia, and who are not employees of The DANNON Company, Inc. (“Sponsor”), Marketing Drive, LLC, MTVN, or their respective parents, affiliates, subsidiaries, advertising and promotion agencies, or those individuals engaged in any way in the development, production, printing, distribution or execution of this Game, and their immediate family members (spouse and children, siblings, parents and their spouses and in-laws, regardless of where they reside) or anyone living in the households of such employees or individuals, whether or not related. An eligible minor needs to have his/her Parent’s permission to participate. Void outside the 50 United States and the District of Columbia and where prohibited by law. This Game is subject to all applicable federal, state and local laws.
  6. General: By participating, participants (and, if eligible minors, their Parents) agree (a) to release, discharge and hold harmless The DANNON Company, Inc., Marketing Drive, LLC, MTVN and their respective parents, affiliates, subsidiaries, advertising and promotion agencies, and any other individuals engaged in any way in the development, production, printing, distribution or execution of this Game, and the respective directors, officers and employees of the foregoing (collectively, the “Released Parties”) from any liability, claims, losses and damages arising, in whole or in part, directly or indirectly, out of or relating to their participation in this Game and the acceptance, use, misuse or possession of any prize received in this Game; (b) to abide by these Official Rules and decisions of Sponsor and judges which shall be final and binding in all respects; and (c) if a winner, to the use by Sponsor and its designees, and MTVN, of his/her name, city and state of residence and/or likeness for purposes of advertising, promotion and trade in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission, except where prohibited by law; and, upon request, to provide consent to such use in writing (d) all prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose); (e) any portion of the Grand Prize not accepted or used by the winner will be forfeited; (f) the Released Parties are not responsible for any inability of any winner to accept or use any prize (or any portion thereof) for any reason; and (g) any dispute that arises regarding the meaning or interpretation of the Official Rules shall be resolved by applying the laws of New York without regard to conflict of laws provisions therein, and shall be solely and exclusively brought in the state or federal courts located within that state; and (i) the Released Parties are not responsible for the cancellation or postponement of the Block Party, the meet and greet with various NBB members, or any elements thereof, as these elements are subject to scheduling, production and legal requirements, Acts of God and other considerations. Sponsor reserves the right, at its sole discretion, to modify or terminate this Game in the event of any act, occurrence or reason which it believes would corrupt the integrity, proper play or fairness of the Game, and, if unclaimed, award the prizes at random from among all eligible, non-suspect Second Chance entries received up to time of such action. Sponsor may disqualify anyone from participating in the Game or winning a prize (and void all associated prize claims or game piece requests) if, in its sole discretion, it determines that such person is attempting to undermine the legitimate operation of the Game by cheating, deception or other unfair playing practices, or intending to annoy, abuse, threaten or harass any other participant or Sponsor’s representatives or who is otherwise not in compliance with the terms of these Official Rules.
